In California a breach of the duty of care depends on the type of case
and facts involved.
Generally, a breach of the duty of care occurs when the defendant fails
to act a reasonably prudent person would have acted under similar circumstances.
In some personal injury cases, a plaintiff will need an expert witness
to prove breach, as in cases of medical malpractice, where a physician
must testify on the issue of breach.
